1. Parties and Purpose
This Candidate Representation Agreement (Agreement) is entered into between AH Recruitment Group (Agency, we, us or our) and the candidate named above (Candidate, you or your).
The purpose of this Agreement is to authorise AH Recruitment Group to assist you with suitable employment, contractor, temporary, fixed-term or other work opportunities and to set out how your personal information may be used for recruitment purposes.
2. Nature of Representation
AH Recruitment Group acts as an independent recruitment intermediary and is not your employer.
Unless agreed separately in writing, this Agreement is non-exclusive. You may still apply for roles directly or through other recruiters.
AH Recruitment Group provides services to candidates free of charge. You will not be charged a recruitment placement fee by AH Recruitment Group for being represented.
Nothing in this Agreement guarantees an interview, job offer, employment, engagement, salary level or employment duration.
3. Authority to Represent You
You authorise AH Recruitment Group to take reasonable recruitment steps on your behalf, including:
discussing suitable opportunities with you;
reviewing and presenting your CV, resume, profile and relevant employment information;
communicating with prospective employers, hiring managers and clients about your suitability for roles;
arranging interviews and assisting with recruitment communications;
providing recruitment-related updates and feedback where appropriate.
AH Recruitment Group will use reasonable care when representing your interests and will act honestly, fairly and professionally in its dealings with you.
4. Consent Before Submission
AH Recruitment Group will not submit your CV, resume or candidate profile to a specific prospective employer without your prior consent, unless you have expressly authorised AH Recruitment Group in writing to represent you for a specific role, employer, industry sector or category of opportunities.
Your consent may be given by email, SMS, telephone confirmation, online form, written message or any other clear communication that confirms you want AH Recruitment Group to put you forward for an opportunity.
5. Candidate Information and Accuracy
You confirm that, to the best of your knowledge:
the information you provide to AH Recruitment Group is true, accurate, complete and not misleading;
your CV, resume and profile accurately reflect your qualifications, work history, licences, skills and experience;
you will promptly notify AH Recruitment Group of any material changes to your availability, employment status, salary expectations, right to work, qualifications or contact details;
you have the legal right to work in the relevant jurisdiction unless you clearly disclose otherwise.
You acknowledge that prospective employers may rely on information provided during the recruitment process when assessing your suitability for a role.
6. Collection, Use and Disclosure of Personal Information
You consent to AH Recruitment Group collecting, using, storing and disclosing your personal information for recruitment and employment-related purposes. This may include:
contact details, CV, resume, employment history, education, qualifications, licences and skills;
salary expectations, work preferences, availability and location preferences;
right-to-work information and identification information where reasonably required for recruitment purposes;
interview notes, screening notes, reference details and communications with you;
information provided by referees, prospective employers or third-party recruitment platforms where authorised or reasonably necessary.
AH Recruitment Group may use this information to contact prospective employers for recruitment-related purposes, including to identify whether suitable employment opportunities may exist for you or other candidates.
AH Recruitment Group may use this information to assess your suitability for roles, contact you, introduce you to prospective employers, arrange interviews, provide recruitment services, maintain recruitment records, comply with legal obligations and manage its business operations.
7. Sensitive Information, Checks and References
AH Recruitment Group will only collect sensitive information where it is reasonably necessary for recruitment purposes and where you have provided consent or the collection is otherwise permitted by law. Sensitive information may include health information, disability information, criminal history information, union membership, racial or ethnic origin, religious beliefs or other information protected by privacy law.
AH Recruitment Group will not conduct reference checks, police checks, medical checks, qualification checks, background checks or similar verification checks unless you have provided consent or the check is otherwise permitted or required by law. Some employers may require separate consent forms for these checks.
8. Storage, Security and Overseas Disclosure
AH Recruitment Group will take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure.
Your information may be stored or processed using secure cloud-based systems, email platforms, document storage, recruitment databases, CRM systems or other business software used by AH Recruitment Group. Some service providers, platforms or prospective employers may be located outside Australia or may store information outside Australia.
AH Recruitment Group will only disclose your information where reasonably connected with recruitment services, where authorised by you, where required by law, or where necessary to protect its legitimate business or legal interests.
9. Access, Correction and Withdrawal of Consent
You may contact AH Recruitment Group to request access to, correction of, or deletion of your personal information, subject to any legal, record-keeping or legitimate business requirements that may apply.
You may withdraw your consent for AH Recruitment Group to represent you at any time by giving written notice. After receiving your withdrawal, AH Recruitment Group will stop representing you for future opportunities as soon as reasonably practicable. Withdrawal will not affect any submission, communication or application already made with your consent before withdrawal.
10. Candidate Responsibilities
You agree to:
communicate honestly and professionally with AH Recruitment Group;
attend scheduled interviews where reasonably possible, or provide reasonable notice if you cannot attend;
notify AH Recruitment Group if you accept another position or no longer wish to proceed with an opportunity;
notify AH Recruitment Group if you are already represented by another recruiter for the same role or employer;
avoid providing false, misleading or incomplete information during the recruitment process.
11. Prospective Employer Decisions
Final hiring, engagement and employment decisions are made by prospective employers or clients. AH Recruitment Group is not responsible for an employer declining an application, withdrawing an offer, changing a role, changing remuneration, delaying a process or ending an employment or engagement relationship.
12. Equal Opportunity and Respectful Recruitment
AH Recruitment Group aims to conduct recruitment activities fairly, ethically and without unlawful discrimination. AH Recruitment Group expects candidates, clients and prospective employers to communicate respectfully throughout the recruitment process.
13. Confidentiality
AH Recruitment Group will treat your candidate information as confidential and will use it only for recruitment-related purposes, business administration, legal compliance or other purposes authorised by you. You agree to keep confidential any non-public client information, role information or recruitment communications that AH Recruitment Group identifies as confidential.
14. Limitation of Liability
To the maximum extent permitted by law, AH Recruitment Group is not liable for indirect, incidental, special or consequential loss arising from recruitment activities, including loss of opportunity, loss of income, reputational loss, business interruption or decisions made by prospective employers.
Nothing in this Agreement excludes, restricts or modifies any right, guarantee or protection that cannot lawfully be excluded, restricted or modified under applicable law.
15. Electronic Communications and Acceptance
You agree that AH Recruitment Group may communicate with you by email, telephone, SMS, online forms, messaging platforms or other electronic methods that are reasonably appropriate for recruitment purposes.
This Agreement may be accepted by physical signature, electronic signature, scanned signature, email confirmation or other written electronic acceptance where permitted by law.
16. Privacy Policy
AH Recruitment Group should provide candidates with access to its privacy policy or privacy collection notice before or at the time candidate information is collected. Until a full privacy policy is published, AH Recruitment Group should make a privacy collection notice available on request.
17. Governing Law and Jurisdiction
This Agreement is governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
18. Entire Agreement
This Agreement records the entire agreement between AH Recruitment Group and the Candidate regarding candidate representation, candidate consent and recruitment-related handling of candidate information, except where another written agreement or privacy notice expressly applies.
